Chairman of the Verkhovna Rada of Ukraine Volodymyr Lytvyn believes that introduction of the institute of individual constitutional appeal in Ukraine will meet social demands and dictates of the time. The Head of the Parliament made this statement, speaking at the conference "Protection of Human Rights by the Bodies of Constitutional Justice: Possibilities and Issues of Individual Access."

 

Welcoming the participants of the conference, V.Lytvyn drew attention to the importance of the discussed topic for both judiciary and the whole Ukrainian society. "It is an undeniable fact that in the context of modern civilization development, protection of human rights and fundamental liberties has turned into an independent leading branch of international law and an essential component of domestic law," he stated.   

 

V.Lytvyn stated that Ukraine lacks the institute of constitutional appeal. Some researchers and experts on law believe that the institute of constitutional appeal as to official interpretation of the Constitution and Ukrainian laws, formalized by the law "On the Constitutional Court of Ukraine", compensates for this lack. He specified that according to the European model of judiciary, constitutional courts verify whether laws conform to the constitution of the respective state, and with the direct appeal of the state authorities allow individuals to address these courts on the issues relating to the violation of their constitutional rights and liberties. V.Lytvyn considers it an individual constitutional appeal and a display of individual access to the bodies of constitutional justice.

 

Commenting on the experience of other countries, V.Lytvyn noted that many foreign and Ukrainian experts stress that "in the domain of protection of human rights and fundamental liberties, the institute of individual constitutional appeal is significant, if not essential, and is not denied a due place in this system, which fully meets the demand of full realization of all opportunities provided for the individual in a truly democratic society in the sphere of protection of rights and fundamental liberties."  

 

V.Lytvyn called for considering the opinion of experts as to raising the level of general legal awareness of Ukrainian people and social demand for fair justice in Ukraine.
