The bill (Reg. No.6343) presents a
new version of the Law "On Charity and Charitable Organizations." People´s
Deputies emphasized that the document improves the legislative base in the
respective sphere, sets the legal and organizational principles, arranges favourable conditions for establishment and activity of
charity organizations, etc. The bill also specifies the purposes, spheres and
types of the beneficent help, in particular, charitable donations and grants,
rights and obligations of the subjects of charitable activity, etc.
The bill enhances state support of the charitable activity, protects the rights of its subjects and state supervision, and sets control in the sphere of charitable activity.
The Committee members focused on the conclusion of the Central Scientific-Expert Department of the Verkhovna Rada of Ukraine Secretariate.
The Central Scientific-Expert Department of the Verkhovna Rada of Ukraine Secretariate is convinced that considering the purposes (directions) of charitable activity fixed by clause 3 of the bill, the document can not restrict the control functions to the finance and customs bodies and tax service of Ukraine only: since charitable activity is performed in the spheres of education, public health, culture and art, the list of supervising bodies shall be supplemented with the respective central executive authority bodies.
Representatives of NGOs emphasized that the bill met the recommendations of the Committee of Ministers of Council of Europe member states as to the legal status of non-governmental organizations in Europe (№ СМ/Rec(2007)14[1]).
According to the Committee members, the bill (in part of simplification of the registration of charitable organizations) "contains amendments that can improve general state of charitable activity in Ukraine."
