The
bill (Reg. No.5479)
amends clauses 32, 102, 112 of the Code of Criminal Procedure of Ukraine and authorizes certain customs bodies to
hold prejudicial inquiry in the cases on smuggling (clauses 201, 305 of the
Criminal Code of Ukraine).
The People´s Deputies expressed several remarks regarding the bill. Namely, the Committee members stated that implementation of the bill requires extra expenses from the State Budget of Ukraine, while reference to the institutional capacity of the State Customs Service of Ukraine is not accrued to a proof.
According to the Committee members, formation of investigative forces in the system of customs bodies will require competent personnel, organizational, financial, material and technical, research, methodological, informational and other support, not only concerning customs bodies but also bodies in charge of supervision over the respective investigative forces in the system of customs bodies, such as prosecution and court bodies.
Thus, the parliamentarians stressed that under part 3 of clause 91 of the Standing Orders of the Verkhovna Rada of Ukraine the bill shall be supplemented with the financial-economic substantiation.
