The Committee on Justice supports the Bill on Amendments to the Code of Ukraine on Administrative Infringements (re Extension of the Term of Administrative Detention exclusively upon Court Order)

The bill (Reg. No.3481) harmonizes
the Code of Ukraine on Administrative Infringements with the Council of Europe
Convention for the Protection of Human Rights and Fundamental Freedoms.
According to the People´s Deputies, the bill suggests the following amendments:
additional procedural rights for the individuals-subjects of the administrative
proceedings; change of administrative detention procedure; regulation of the
appeal procedure in cases on administrative infringements.
The People´s Deputies deems necessary to introduce
amendments to improve the individual rights and liberties protection in the
course of administrative proceedings.
Moreover, the Committee members focused on the
fact that certain items of new clause 297-2 suggested by the bill require
specification. Namely, it is not clear what data concerning the appealer shall
be indicated.
