The Agreement defines the terms concerning
classified information,
regulates the procedure
of mutual exchange and treatment of the classified information, and the visits of heads of both states, harmonizes
equivalence of ‘restricted´ label, determines compent
bodies of both parties, in
charge of implementation of the Agreement, regulates procedural and control issues, etc.
The subjects of the Agreement are state authority bodies, enterprises, establishments and organizations conducting activity connected with the state secret in compliance with the legislation of Ukraine and the license for transferring the classified information to the foreign partner.
According to the Agreement, the competent body of the Ukrainian party is the Security Service of Ukraine.
According to the legislation of Ukraine, namely, clause 32 of the Law "On State Secret", secret information and its tangible medium shall be transferred to a foreign country or an international organization only under the international agreements ratified by the Verkhovna Rada of Ukraine or by a written substantiated order of the President of Ukraine.
