The Committee members passed a unanimous decision that the Foreign Affairs Committee should recommend The Verkhovna Rada of Ukraine to reject the bill "On Ratification of the Agreement between Ukraine and the Russian Federation on the Stay of the Black Sea Fleet of the Russian Federation in the Territory of Ukraine" (Reg. No. 0165) as such that contradicts the Constitution and the laws of Ukraine.
The People´s Deputies stated that the Agreement violates several substantive and procedural legal norms. Thus, it contradicts Clause 17 of the Constitution of Ukraine, pursuant to which the location of foreign military bases in the territory of Ukraine shall not be permitted.
According to the Committee members, "signing the said Agreement, the President of Ukraine violated Clause 20 of the Law of Ukraine "On the International Agreements of Ukraine", pursuant to which "the international agreements of Ukraine can be prolonged on conditions set by the respective agreements." They also stressed that "the effective Agreement between Ukraine and the Russian Federation on the status and terms of stay of the Black Sea Fleet in the territory of Ukraine of 28.05.1997 envisage its potential prolongation for five years only."
The Committee members passed a unanimous decision that the Foreign Affairs Committee should recommend The Verkhovna Rada of Ukraine to pass the draft resolution "On Non-Acceptance of the Agreement between Ukraine and the Russian Federation on the Stay of the Black Sea Fleet of the Russian Federation in the Territory of Ukraine" (Reg. No. 6332) drafted by People´s Deputies B.I.Tarasiuk and O.H.Bilorus. Moreover, the Committee members passed a unanimous decision that the Committee on Rules of Parliamentary Procedure, Ethics and Support to Work of The Verkhovna Rada of Ukraine recommend The Verkhovna Rada of Ukraine to pass the draft resolution "On setting up a Temporary Inquiry Panel of The Verkhovna Rada of Ukraine to investigate Potential Elements of Crime in the Actions of V.F.Yanukovych, President of Ukraine, and the Officials of the Cabinet of Ministers of Ukraine by the Conclusion and Signing of the Agreement between Ukraine and the Russian Federation on the Stay of the Black Sea Fleet of the Russian Federation in the Territory of Ukraine" (Reg. No. 6333) drafted by People´s Deputies B.I.Tarasiuk and O.H.Bilorus.
