The bill (Reg. No5307) suggests the strengthening of the criminal liability for the non-compliance with a court ruling of the courts of general jurisdiction, Constitutional Court of Ukraine and European Court on Human Rights.
In the course of the bill discussion, the Committee members expressed a number of remarks.
S. Kivalov, the Chairman of the Committee on Justice emphasised that the defining of the separate clause 351-1 is incorrect according to him. He is convinced that it would be more efficient to amend the clause 376 of the Criminal Code "Interference into the activity of the court bodies" by the separate part according to which the constitutional jurisdiction is one of the ways of judicial power implementation in Ukraine.
Moreover, during the sitting a number of bills were expressed regarding the defining of the penalty rate from one to two thousand tax-free allowances. According to the part two of the clause 53 of the Criminal Code of Ukraine the penalty rate is envisaged in the framework from 30 to one thousand tax-free allowances.
S. Kivalov stated that the suggested revision of the part one of the clause 382 of the Criminal Code "is not correct as according to the Law "On Constitutional Court of Ukraine" non-compliance with the court rulings envisaged the amenability pursuant to the Law"
