The participants of the meeting discussed the principles of the bills on Amendments to the Law "On Operative-Investigative Activity" (Regarding the Right for the Customs Bodies on Operative-Investigative Activity) (Reg. No5478) and on amendments to the Criminal-Procedural Code of Ukraine (Reg. No5479).
I. Kaletnik, the Chairman of the Committee, opening the meeting emphasized that today fighting smuggling activity except customs services is conducted by the Ministry on Internal affairs, Security Service, State Border Services and State Taxation Service of Ukraine. Though, the customs services, in comparison with other services do not possess the law-enforcement status and corresponding authority.
Moreover, the People´s Deputies deem the lack in customs bodies the right for the investigative-operative activity do not facilitate the effective cooperation and information exchange with the foreign customs services.
In the course of the discussion, certain remarks concerning the vesting the customs bodies with the right to conduct operative-investigative activity were expressed.
The authors instead emphasized that the aim of the bills is vesting only separate dignitaries of the customs subdivision with the right to conduct operative-investigative activity.
In the course of the sitting it was emphasized that pursuant to the reformation Conception of the criminal justice of Ukraine, it is envisaged to form the finance police in Ministry on Finance system.
According to the People´s Deputies, conduction operative-investigative activity and pre-trial investigation by the customs bodies harmonize with this Conception and moreover vesting the customs bodies extra authority, elimination of the procedural imbalance is an essential step in the formation of the finance police as the only body that would combine subdivisions of taxation policy and subdivisions of the customs bodies for the corruption fighting.
