Oleksandr Lavrynovych: Initiators of the Provocative Actions connected with the High Administrative Court of Ukraine are trying to disrupt the Activity of this Court.
It was declared by the First Deputy Chairman of the Verkhovna Rada of Ukraine in the course of the interview for the "Inter" television channel journalists.
"The problem concerning the office of the Chairman does exist, still it will not influence the judgments made by this court", - O. Lavrynovych proclaimed.
Giving answers to the questions that is more legitimate on this position, either O. Paseniuk, the present Chairman of High Administrative Court of Ukraine, or self appointed Chairman M. Sirosh, the politician stated that the problem appeared in accordance with the fact that the effective legislation does not regulate, which body appoints candidates for the administrative offices in the courts.
According to his words, "it is necessary to understand now that under conditions when the Law has not defined the body, that is supposed to appoint on the administrative offices in the courts, the person that have been working before and who was elected in the course of the conference, held by the whole specialized juridical system, is sure to be more legitimate then the person that appointed himself on the court head position."
O. Lavrynovych emphasized: "Authority conferred by the office of the effective High Administrative Court Chairman nobody has terminated. When the authorities are terminated, then the decision is always adopted concerning the nomination of the next Chairman, hence the person used to occupy the position is dismissed before the nomination. On practice we observed usual raider attack."
O. Lavrynovych supposes that "actually the sense of this artificially made situation is to make the chaos, disorganize the High Administrative Court in order to declare that it is not able to work at all, consequently let the Supreme Court scrutinize it."
Giving the answer to the question, for whom it is advantageous, as the High Administrative Court is the only institution that reviews the cases concerning the election returns, O. Lavrynovych stated: "It is the person who is searching today all the possible opportunities to form the public opinion as though there are certain obstacles concerning fair election returns."
