Oleksandr Lavrynovych: Court shall be Independent, its Resolutions being Lawful

 

"Pursuant to the effective legislation of Ukraine, citizens, political parties, candidates for presidency have the right to turn to court, provided they have claims that confirm violations of rights of the said candidates or individuals. The present-day legislation minimizes abuse of this right", - Oleksandr Lavrynovych, First Vice-Chairman of The Verkhovna Rada of Ukraine, stated in the interview to Inter Channel. He commented on the public rumors that certain political forces would use such methods to influence on the results of the presidential elections.

 

The politician stated that the results of the presidential campaign were hardly predictable, as "all the latest campaigns have ended actually in court, except the parliamentary campaign in 2007". He believes that "one political force that fails can not accept its failure and takes all available measures to distort the results of public will or repeat the election process".  

 

O. Lavrynovych stressed that "the Ukrainians see that the Party of Reasons, unlike the orange political forces, has a lawful stand and acts like all the European Parties".  

 

"When we had no possibility to set up a capable coalition to rule the country after the elections, it was in the very night of elections that we called on the other side to set up a coalition, make it stable and assume the responsibility for the country", - the politician stated. He summarized: "The outcome of this situation was apparent. At present, it is necessary to answer for the results of such work".

 

As far as the role of courts during the elections was concerned, O. Lavrynovych stressed: "The courts shall be powerful, independent and fair, its resolutions being lawful". However, he stated that "Ukrainian experience proves the opposite, especially the resolution of the Supreme Court of Ukraine that regulated the third round of the presidential elections 2004, which violates the Constitution and the Laws of Ukraine".

 

The politician also stated that the effective Law on the presidential elections envisaged the right to appeal against the results of the elections to the Higher Administrative Court that shall scrutinize the available evidence and pass a relevant resolution.

 

"It is impossible to deprive the judicial branch of the right to revise the results of elections, as it is the only branch of authority authorized to restore the violated rights and establish equity", - O. Lavrynovych summarized.
