The Committee on Legislative Support of Law Enforcement recommends that the Parliament adopts as Basis the Bill on Amendments to certain Legislative Acts of Ukraine concerning Responsibility for Anti-Competitive Coordinated Actions

The Bill (Reg. No.3577) submitted by the Cabinet of Ministers, introduces a new version of Article 228 of the Criminal Code that envisages criminal responsibility for "anti-competitive coordinated actions". The Bill supplements Part 5 of Article 221 of the Criminal Procedural Code and excludes Article 1662 "Illegitimate Agreements between Entrepreneurs" from the Code of Ukraine on Administrative Infringements.

The Committee members studied the Bill and stated that efficient realization of competitive policy was hampered by the actual lack of proper legal mechanism of detection and suspension of secret agreements between the competitors that destroy market mechanisms.
