The Committee on Social Policy and Labour recommends that Verkhovna Rada of Ukraine adopt the Bill on Amendments to some legislative acts of Ukraine on bringing it in correspondence with the Convention International Trade Union Organization №87 on protection of the right on organization 9regarding the trade union rights abidance).
According to the Bill (Reg. №1431) supplied by the People´s Deputy M. Volynets in stead of, it is proposed to withdraw the trade union and everything connected with them from the scope of validity of the "Law on State Registration of Juridical persons and Natural Persons-Entrepreneurships", introducing the amendments to items 3, 80, 89 of Civil Code of Ukraine, items 2,16 of the Law "On Trade Unions their Rights and Guarantees of Activity", in particular item 16 should be introduced in new edition, according to which "trade unions acquire the state of juridical bodies from the moment of their statute adoption without the confirmation of the state by the legalizing body"
The Members of the Committee stressed that the Certificate of the State Registration implement the fact of juridical person status acquirement.
It is also supposed to complement the Code of Ukraine on Administrative Violation with the new item "The Violation of Law on Trade Union".
The Committee recommends that the bill should be adopted as a basis as the amendments suggested by the bill will regulate the issues on the activity of trade union without obstacles in their work.
