The law presupposes that the secretary of village and city council work in it on the constant basis and is elected by the council from its members.
The proposition as to the candidate of the secretary can be sent for the discussion of the council not less than by one third of the Deputies if:
on the moment the session of the council, that was elected on the regularly elections, is held the elections of the village or city mayor are not completed;
council does not supported the candidate proposed by the mayor;
during 130 days from the opening of the first session of the council, the mayor does not proposed the candidate for the post of the secretary;
on the next regular session after the vacant place appeared according to the pre-term cessation of his commissions the corresponding village or city mayor does not proposed the candidate;
The post of the secretary becomes vacant during the post of corresponding village or city mayor is also vacant according to pre-term cessation of his commissions
