The Bill (Reg.No.1465) aims to regulate matters relating to a specific type of business activity, i.e. Security of property and natural persons.

 

It envisages that ‘Licensing of activities related to the security of State-owned and other property, and Security services to individuals, as well as the Licence conditions of their operation and monitoring procedures, shall be laid down in this Law, allowing for the specific features as defined by The Cabinet of Ministers of Ukraine´.

 

According to the Bill, business entities engaged in services related to the Security of State-owned and other property, and rendering of services to individuals, shall, within two months of the relevant Act, issued by the Cabinet of Ministers, taking effect, apply to the Licensing bodies to issue a new Licence. Should such an entity fail to keep within this timescale, the Licence previously issued shall be deemed invalid.

 

Despite the absence of a basic Law of Ukraine ‘On the Security Business´, a considerable number of matters related to the carrying out of Security Services can be regulated before such a Law has been adopted, and in particular through a Legislative Act issued by the Cabinet of Ministers of Ukraine. These are matters of the educational level of Security Guards, requirements of their uniform, the relevant identification livery of vehicles used for the security of property, definition of special tools and conditions for their usage; and terms of interaction between Security Companies and Law Enforcement agencies.
