Committee members deliberated on the following Bills:

 

On amendments to the Law ‘On Privatisation of State Housing Fund´ (appertaining to privatisation of rooms in hostels) introduced by the People´s Deputies, M. Syrota and M. Derkach (Reg. No. 1199);

 

On amendments to the Law ‘On Privatisation of State Housing Fund´ (appertaining to privatisation of living areas in hostels ), whose Sponsors are the People´s Deputies, A. Matvienko and O. Bondar (Reg. No. 1240);

 

On Introducing a Moratorium for the alienation of hostels, introduced by the People´s Deputies, M. Derkach and M. Syrota (Reg. No.1385);

 

On securing the realisation of Housing Rights by hostel residents, introduced by the People´s Deputies, V.Rybak, V. Baranov, Ye. Volynets, et al (Regna. 2009).

 

The Bill No.1199 proposes amendments to the current Law, to permit privatisation by hostel residents, of those rooms in hostels which are only intended for families and single persons.

 

The Bill No. 1240 proposes to permit privatisation, by hostel residents, of only the living areas in hostels.

 

The Bill No.1385 proposes a Moratorium, to be imposed until 01.01.2009, for the alienation (apart from transferral into ownership of the relevant local Councils) of hostels that are totally run or managed by companies, organisations and establishments, whatever their property status.

 

The Bill No.2009 purports a comprehensive legal adjustment of the realisation of a Constitutional Right for housing, for those citizens lawfully residing in hostels for workers and small families for a long period (over 5 years), who have no housing of their own, and are unable to buy or build a house. The document proposes the transferral of hostels owned by companies, and set up during privatisation, and the incorporation of previously State-owned enterprises into the ownership of respective territorial communities; entitling hostel residents to privatise their rooms in hostels; impose a ban on expulsion from hostels other than with provision of suitable permanent alternative housing; making appropriations towards major repair and reconstruction of hostels, etc. This Bill shall not apply to hostels providing temporary residence, such as are intended for students or contract workers.

 

The outcome of these discussions involving Committee members, the Sponsors of these Bills and Representatives from The Ministry of Housing and Utility Services, Ministry of Finance, and State Property Fund, was that Bill No. 2009 was recommended to be taken as a basis for further deliberations.

 

The Committee recommends that The Verkhovna Rada of Ukraine adopts the Bill (Reg. No. 2009) as a basis for further deliberations, and that the proposals and comments from the legislative initiators and the relevant provisions of the Bills Nos 1199, 1240 and 1385 are taken into account during the preparation of this Bill for the Second Reading.
