Committee members emphasized that the Bill (Reg. No. 2013) provides for creation of legal grounds for examination by the Higher administrative court of administrative cases concerning dismissals from public service of the officials who are appointed on the post and dismissed from it by Verkhovna Rada, President of Ukraine or Cabinet of Ministers.
The People´s Deputies have generally agreed that amendments proposed by the Bill, "which virtually make impossible reopening cases of Higher administrative court in cases concerning dismissals from and appointments to the posts by Verkhovna Rada, President of Ukraine or Cabinet of Ministers of specific persons, can lead to infringement of citizens´ rights during their appeal of the legal acts with individual effect".
Furthermore, the People´s Deputies generally agreed, that this Bill is premature, because to date a new version of the Law "On Public Service" is being developed and these issues should be solved by it.
