The Bill (Reg. No.2153) reduces influence of human factor on determination of culpability or non-culpability in perpetration of a crime whilst ascertaining the fact of puberty. Such specification of the regulation simplifies the tasks of law-enforcement bodies regarding establishment of guilt of penetration of the said crime.
The Bill introduces amendments to Article 155 of the Criminal Code of Ukraine. Thus it substitutes the words "that is not sexually mature" with the words "that has not reached 16 years of age".
According to the Committee members, the Bill deals with socially important and urgent issues.
The Committee fails to concur with the resolution of the Central Scientific Experts Office of The Verkhovna Rada of Ukraine that recommends rejecting the Bill at the First Reading.
The Committee members upheld the Bill, since its adoption will enhance criminal and legal regulation in the field of person´s sexual inviolability protection.
