MPs adopted such a decision following the results of December 10 joint meeting of parliamentary committees where a hearing was granted to Prosecutor General V.Yarema, Minister of Internal Affairs A.Avakov, and Chairperson of the Security Service of Ukraine V.Nalyvaichenko about measures that are being taken on the pre-trial investigation of crimes against humanity, life, and health of civilians during peaceful protests during November 30, 2013–February 22, 2014 committed by law-enforcement bodies and other persons.
MPs pointed to absence of concrete results in investigating criminal offences.
The joint decision states that pre-trial investigation of crimes is carried out separately by investigators of Prosecutor General's Office, prosecutor offices of Kyiv, oblast, city, and region prosecutor's offices, as well as investigators of the Ministry of Internal affairs and the Security Service of Ukraine which does not allow meaningful and effective coordination.
According to the adopted decision, "responsibility for improper investigation of the abovementioned crimes rests, primarily, on the Prosecutor General's Office of Ukraine".
The joint decision also claims that "incorrect strategy and improper organization of investigations of the abovementioned crimes leads to significant negative legal and social consequences".
MPs upheld the decision of Prosecutor General to create a special department on investigating crimes committed against participants of protests actions in Kyiv and other Ukrainian cities during November 30, 2013–February 22, 2014 and other crimes committed by a criminal organization.
The joint decision of the Committees recommends that the Prosecutor General's Office, Ministry of Internal Affairs, and the Security Service of Ukraine should conduct internal investigations in order to find out reasons and persons who led to improper or deliberate delaying the investigation of criminal offences committed against participants of protests actions during November 30, 2013–February 22, 2014.
The Committee members also adopted a decision to inform President of Ukraine P.Poroshenko and Prime Minister of Ukraine A.Yatseniuk about inefficient work of prosecutor's office authorities and other pre-trial investigation authorities on investigating crimes against humanity, life, and health of civilians during peaceful protests during November 30, 2013–February 22, 2014 committed by law-enforcement bodies and other persons.
