At a meeting on 4 January, the Committee on Ukraine's Integration into the EU considered draft law No. 10216 (https://itd.rada.gov.ua/billInfo/Bills/Card/43093) on amendments to the Code of Ukraine on Administrative Offences regarding administrative liability for falsifying the mileage of a used vehicle. According to the initiator of the draft law, the practice of falsifying the mileage of a used vehicle when selling it is quite widespread today. In order to prevent misleading buyers, as stated in the explanatory note to the draft law, it is proposed to establish administrative liability for falsifying the mileage of a used vehicle for the purpose of selling it to third parties, which is detected during the registration (re-registration) of the vehicle. It is also proposed to designate the National Police of Ukraine as the body that will draw up reports on administrative offences. The Committee concluded that the draft law does not contradict the objectives of the Association Agreement and Ukraine's international legal obligations, but needs to be revised to take into account the provisions of Directive 2014/45/EU.
At the meeting, the Committee members also considered and adopted conclusions on the following draft laws:
Draft Law No. 10218 (https://itd.rada.gov.ua/billInfo/Bills/Card/43122) on Amendments to the Law of Ukraine "On Scientific and Scientific-Technical Activities" on Research Infrastructure and Support for Young Scientists. The document proposes to improve the provisions of the Law of Ukraine "On Scientific and Scientific-Technical Activities" regarding the creation of conditions and rules for the activities of various entities of the research infrastructure and the promotion of their association for the optimal use of fixed assets. The Committee concluded that the draft law does not contradict Ukraine's obligations under the Association Agreement and EU law, but needs to be further developed to comply with the principle of legal certainty.
Draft Law No. 10337 (https://itd.rada.gov.ua/billInfo/Bills/Card/43386) on fair lobbying. The explanatory note states that the draft law was developed to ensure the legal framework for lobbying in Ukraine in accordance with international practices and standards, regulatory and legal regulation of the interaction of officials of state authorities and local self-government bodies with stakeholders and lobbying entities, and to establish transparent mechanisms for the activities of lobbying entities and officials of state and local self-government bodies. As well as mechanisms for controlling lobbying activities. According to the Committee, the draft law does not contradict Ukraine's international legal obligations in the field of European integration, but needs to be revised to fully take into account European standards. The Committee adopted the same conclusions on alternative draft laws No. 10337-1 on lobbying and lobbying activities in Ukraine and No. 10337-1 on state registration of lobbying entities and lobbying in Ukraine.
Draft Law No. 10217 (https://itd.rada.gov.ua/billInfo/Bills/Card/43121) on amendments to certain laws of Ukraine on the regulation of the functioning of territories affected by radioactive contamination as a result of the Chornobyl disaster. The document proposes to allocate a special industrial use area within the exclusion zone and the zone of unconditional (mandatory) resettlement, to arrange it, and to introduce rules for conducting economic activity there in compliance with the radiation safety regime. According to the Committee, the Draft Law does not contradict Ukraine's obligations under the Association Agreement and EU law.
Draft Law No. 10155 (https://itd.rada.gov.ua/billInfo/Bills/Card/43006) on Amendments to the Law of Ukraine "On Topographic, Geodetic and Cartographic Activities" regarding the development of modern geoinformation resources in the field of topographic, geodetic and cartographic activities. As stated in the explanatory note, the draft law was developed to improve the regulation of topographic, geodetic and cartographic activities, aimed at creating, developing and operating modern geoinformation resources to ensure the integration of the national geospatial data infrastructure into the global and European infrastructures. The Committee concluded that the draft law does not contradict Ukraine's international legal obligations in the field of European integration and EU law. The Committee members adopted the same conclusion regarding the alternative draft law No. 10155-1.
Draft Law No. 10207 (https://itd.rada.gov.ua/billInfo/Bills/Card/43094) on amendments to certain laws of Ukraine on the management of pesticides and agrochemicals in Ukraine. The draft law, in particular, proposes to postpone the introduction of new requirements for pesticide and agrochemical labels. The Committee concluded that the draft law does not contradict Ukraine's international legal obligations in the field of European integration and EU law.
Draft Law No. 10246 (https://itd.rada.gov.ua/billInfo/Bills/Card/43118) on amendments to certain legislative acts of Ukraine regarding the regulation of certain issues of land lease. The document proposes to introduce the possibility of leasing a part of a land plot that has been formed and the information about which has been entered into the Land Cadastre. According to the Committee's conclusion, the draft law does not contradict Ukraine's international legal obligations in the field of European integration and EU law.
Draft Law No. 10304 (https://itd.rada.gov.ua/billInfo/Bills/Card/43301) on amendments to the current legislation on improving corporate governance in companies. The draft law, as stated in the explanatory note to it, was developed with the aim of providing proposals and amendments to special laws regulating the specifics of management in business legal entities in terms of defining the activities of the company's management bodies and their officials. The Committee concluded that the draft law does not contradict the provisions of the Association Agreement and Directive 2017/1132.
Draft Law No. 10305 (https://itd.rada.gov.ua/billInfo/Bills/Card/43306) on amendments to the Civil Code of Ukraine. The draft law, as stated in the explanatory note to it, was developed to provide proposals and amendments to the current Civil Code of Ukraine regarding the legal regulation of the legal entity in terms of the need to improve the provisions on the governing bodies of a legal entity and to clarify the concept of corporate rights of legal entity participants. According to the Committee, the draft law does not contradict the provisions of the Association Agreement and Directive 2017/1132.
