Adopted as a basis the Draft Law No. 3515 "On Amendments to Certain Legislative Acts of Ukraine Concerning the Regulation of the Subsistence Minimum Formation and Creation of Preconditions for Its Increase".
The purpose of the draft law is to ensure the constitutional right of citizens to a sufficient standard of living by introducing a new methodology for calculating the subsistence level, which establishes basic state social guarantees and social benefits, which are the main source of human existence.
In addition, there is a need to improve the legislation governing administrative fees, fines and penalties for administrative, criminal and other violations, which are currently set from the amount of tax-free minimum and subsistence minimum.
The bill provides for a change in the definition of the subsistence level, establishing that it is an acceptable level of expenditure that allows to maintain a sufficient standard of living, inherent in society. It is proposed to determine the size of the subsistence minimum per person.
It is assumed that the subsistence level should be set as a percentage of the average monthly wage in Ukraine for the year preceding the year of formation of the State Budget of Ukraine for the next year, taking into account the projected inflation rate for the current year.
