Adopted as a basis the draft Law No. 4409 “On Amendments to the Bankruptcy Procedure Code of Ukraine”.
The purpose of the draft Law is to eliminate technical inconsistencies and shortcomings, resolve controversial issues and harmonize some provisions of the Code.
The changes proposed by the draft Law concern, in particular:
- unification, elimination of differences in terminology throughout the text of the Code;
- changes related to the introduction of the automated system ‘Bankruptcy and insolvency’;
- improving the procedure for selecting arbitration trustees in bankruptcy cases;
- exclusion from the text of the Code of incorrect or contradictory norms, as well as specification of the provisions of the Code;
- bringing the provisions of the Code into line with the legislation in the field of archives and record keeping;
- setting clear deadlines for repaying creditors' claims and eliminating the possibility of abuse by the arbitration trustee;
- settlement of the issue of treatment of the bankrupt's property after the closure of the bankruptcy proceedings.
