During the meeting, the Committee on Anti-Corruption Policy considered the draft Law “On the Territories of the Emerald Network” (No. 4461) for compliance with the requirements of anti-corruption legislation.
The draft law aims to establish the legal and organizational basis for defining the territories of the Emerald Network and managing them in Ukraine to preserve natural habitats and species of fauna and flora that are subject to special protection.
The draft law defines the legal and organizational framework for impact assessment in the Emerald Network in the decision-making process on economic activities that may have a significant impact on such areas.
During the discussion, MPs stressed the importance of the bill, which, in particular, is aimed at fulfilling Ukraine’s obligations under international agreements. At the same time, they made a number of comments on the draft law concerning legal uncertainty and the granting of discretion to the competent authorities.
In particular, according to the members of the Committee, the bill contains wording that is evaluative in nature; there is no definition of the term "territory of the Emerald Network"; the scope of the study and the level of detail of the information to be included in the report on the impact assessment on the territory of the Emerald Network have not been determined; at the level of the law the criteria for determining the probable negative impact of activities on the territory of the network are not prescribed; there is no list of activities for which an impact assessment is required in such areas; it is envisaged that the commissioner of the new central executive body will independently decide who will conduct the impact assessment on the territory of the Emerald Network.
The Committee decided to recognize the draft law as inconsistent with anti-corruption legislation and containing corruption risks.
