The draft law No. 5273 proposes to amend Article 48 of the Law of Ukraine "On Physical Culture and Sports", supplementing it with a new part, according to which "Property, including land, liquidated state and municipal institutions of physical culture and sports or those whose activities are suspended, in accordance with the decision of the founder may be used exclusively for the provision of physical culture and sports services, including on the basis of public-private partnership".
During the discussion of the bill, the members of the Committee supported the legislative initiative. At the same time, people's deputies noted that in order to avoid contradictions with Article 143 of the Constitution of Ukraine, it is expedient to state the second paragraph of the first part of Section I of the draft law as follows: "The property of liquidated state and municipal institutions of physical culture and sports is used without changing its purpose."
The members of the Committee also decided to take a legislative initiative to amend Article 20 of the Land Code accordingly, providing that "Change of purpose of land plots provided for construction and maintenance of sports facilities is not allowed", which will allow, in case of adoption of such norm, to establish responsibility for its non-fulfillment, which is determined by Article 21 of this Code (the relevant draft Law is registered under No 5434).
The Committee decided to recommend to the Verkhovna Rada, based on the results of the consideration of the draft Law in the first reading, to adopt it as a basis and in general, taking into account the proposals of the Committee.
