For the first time in the history of Ukraine, the Office of the Prosecutor General announced to the MP suspicion of impersonal voting, or as it is popularly called – ‘button-pressing’. First Deputy Chairperson of The Verkhovna Rada of Ukraine Ruslan Stefanchuk commented on the decision of the Prosecutor General's Office.
“Well, in the end it happened. This is the best answer to those who have said that criminal liability for button-pressing does not work. Everything works as soon as the law enforcement agencies start working. Then it's up to the courts,” Ruslan Stefanchuk said.
“Let me remind you that on my legislative initiative, in December 2019, the Parliament adopted the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine to Ensure Personal Voting by the MPs of Ukraine at the Plenary Sessions of the Verkhovna Rada of Ukraine.” In accordance with this Law, the Criminal Code of Ukraine was supplemented by the new Article 364-2 ‘Voting by MP of Ukraine in the place of another MP of Ukraine’. I wrote in the media about the public danger of such an act and the need to criminalize it,” the First Vice Speaker of the Parliament of Ukraine added.
According to the First Deputy Chairman of The Verkhovna Rada of Ukraine, regardless of the method of decision-making by the Parliament of Ukraine, personal voting of the MP of Ukraine provides for his personal participation in the voting process and compliance with the requirements established by the Constitution of Ukraine for the MP of Ukraine to dispose only of his right to vote, the prohibition to delegate it, as well as the prohibition of coercion to transfer this right.
“Failure to comply with these requirements contradicts the nature of the representative mandate of the MP of Ukraine, who is the representative of the Ukrainian people in the Verkhovna Rada of Ukraine, and the principle of equality of the status of MPs. I sincerely hope for an objective and impartial consideration of this case, as well as for the fact that after this precedent, button-making as a phenomenon will disappear from the Parliament of Ukraine forever,” Ruslan Stefanchuk expressed his hopes.
