The draft law No. 3959-1 proposes to determine the legislative basis for the creation and implementation of certain tasks of an independent state law enforcement agency, which, inter alia, must perform the functions of analytical assessment, prevention, detection, termination, investigation and disclosure of criminal offenses referred by law to its jurisdiction.
The bill establishes the following conceptual provisions:
In the Code of Administrative Offenses:
а) determined the responsibility of employees of the Bureau of Economic Security of Ukraine, who have special ranks, for administrative offenses under disciplinary statutes;
б) provides for administrative liability for illegal use of the name and signs of belonging to the Bureau of Economic Security of Ukraine.
The Criminal Code introduces liability for fraud with value added tax as a separate type of criminal offense. A number of other corpus delicti are also being amended in connection with the establishment of the Bureau of Economic Security of Ukraine. Ensuring its independence and a special procedure for investigating criminal offenses committed against its employees.
In the Criminal Procedure Code:
а) determined the main and additional jurisdiction of the Bureau of Economic Security of Ukraine;
б) the necessary changes have been made to introduce a new subject - the Bureau of Economic Security of Ukraine;
в) assigned powers to carry out covert investigative (search) actions by operational units of the Bureau of Economic Security of Ukraine, and other changes are proposed for the proper pre-trial investigation of criminal offenses under the jurisdiction of the Bureau of Economic Security of Ukraine.
