Adopted the Law of Ukraine “On Democracy Through All-Ukrainian Referendum.” The Law of Ukraine specifies in detail all the procedures, legal status, the holding of referendums, the status, rights, responsibilities, requirements regarding all the subjects of organization of a referendum.
The Law provides for the following subject areas for a referendum:
- approval of the law on amendments to Sections І, ІІІ, XIII of the Constitution of Ukraine;
- deciding on a matter of national significance;
- changing the territory of Ukraine;
- declaring invalid a Law of Ukraine or its individual provisions.
The following issues cannot be placed on a referendum:
- issues contravening the provisions of the Constitution, the universally recognized principles and norms of international law, in the first place those entrenched in the Universal Declaration of Human Rights, the Convention for the Protection of Human Rights and Fundamental Freedoms and its protocols;
- proposals to abolish or restrict the constitutional rights and freedoms of man and citizen and guarantees of their implementation;
- proposals aimed at eliminating the independence of Ukraine, violating the state sovereignty or territorial integrity of Ukraine, creating a threat to the national security of Ukraine, inciting interethnic, racial, religious hatred;
- issues related to taxes, budget, amnesty;
- referred by the Constitution of Ukraine and Laws of Ukraine to the jurisdiction of law enforcement agencies, prosecutors’ office or courts.
The law defines the basic principles of holding an all-Ukrainian referendum, on the basis of which an all-Ukrainian referendum is held:
- universal suffrage;
- equal voting rights;
- direct expression of will;
- free participation in the all-Ukrainian referendum;
- voluntary participation in the all-Ukrainian referendum;
- secret ballot;
- personal voting;
- one-time voting;
- publicity and openness of the all-Ukrainian referendum process.
An all-Ukrainian referendum may not be held simultaneously with regular and extraordinary national elections, regular local elections.
