The adopted the Law of Ukraine No. 4460-d “On the Introduction of Amendments to Certain Legislative Acts of Ukraine to Restore Liability for Declaring Inaccurate Information and Failure to Submit a Declaration by a Person Authorized to Perform State or Local Self-Government Functions.”
Adoption of the law allows to eliminate the gap in the legislation in connection with the decision of the Constitutional Court of Ukraine of October 27, 2020 No. 13-r/2020 and prosecute for declaring inaccurate information and failure to submit a declaration by a person authorized to perform state or local self-government functions.
According to the law, administrative penalties will be imposed if the information in the declaration of the person, who is authorized to perform the functions of state or local government, differs from the reliable information in the amount of 100 to 500 subsistence minimums for able-bodied persons (currently from 227,000 to 1,1 million hryvnias (8,023 to 40,117 dollars).
The law establishes criminal liability in the form of restriction of liberty for up to two years with deprivation of the right to hold certain positions or engage in certain activities if the information in the declaration differs from the reliable amount of more than 4,000 living wage for able-bodied persons.
