During its meeting, the Committee on Digital Transformation considered the Proposals of the President of Ukraine to the Law No. 3014 “On Electronic Communications”, adopted by the Verkhovna Rada of Ukraine on September 30, 2020.
On October 29, 2020, the President returned the Law to the Verkhovna Rada and proposed to revise it in order to bring its provisions in line with the Constitution of Ukraine, to eliminate existing gaps and shortcomings.

The President's Proposals state that, according to the Constitution, the regulation of a number of issues can be determined only at the level of laws, and not legislation, as proposed in the Law “On Electronic Communications.” In particular, this issue is: the scope and procedure for access to information posted on the electronic regulatory platform; access to land and infrastructure for the deployment (creation) and operation of electronic communications networks; civil liability of business entities for violations of the legislation on electronic communications and radio frequency spectrum.

In addition, the President proposes that the provisions of the Law governing access to consumer information and electronic communications services received by the end user take into account situations that require emergency action by public authorities in the event of threats to national security, economic prosperity and human rights.
The Committee decided to recommend to the Verkhovna Rada to support the Proposals of the President of Ukraine and to send the Law of Ukraine “On Electronic Communications” for revision to the Committee on Digital Transformation.
