Draft law No.3464 proposes to envisage that persons who held elected positions in local self-government bodies and were called up for military service, and the term of their office expired during the period of active service, will not be entitled to guarantees of preserving the place of work and position.
In this regard, it is envisaged to supplement Article 119 of the Labor Code of Ukraine with a new Section. At that, it is proposed to simultaneously amend Article 33 of the Law of Ukraine "On the status of members of local councils" concerning the provision of previous position (office) or compensation payments to former deputies of local councils, who worked in the councils on a permanent basis and were called up for military service, for the period after their demobilization.
The Committee members supported the draft law as its adoption will allow to avoid unequal application of the legislation by local self-government bodies concerning guaranteeing the preservation of the place of work for workers who served at elected positions in local self-government bodies and were called up for military service, but the term of their office at these positions ended during the period of active service.
