The draft law No. 4091 aims to explain and apply some provisions of the Laws of Ukraine "On local self-government in Ukraine," "On local elections," and "On voluntary unification of territorial communities" touching an opportunity to elect one prefect by voters of several population centers within one unified territorial community on the basis of the decision of respective local council.
In Article 141 of the Law of Ukraine "On local self-government in Ukraine," the draft law offers to note that a prefect is elected in one or several villages and/or small towns picked by village, small town, or a city council of a unified territorial community established in compliance with the Law of Ukraine "On voluntary unification of territorial communities" exclusive of its administrative center. Besides, it is offered to amend the Law of Ukraine "On local elections" and determine that single mandate constituency for election of a prefect is the territory respective population center (-s).
The Committee members based their position on the conclusion of the Central scientific-expert department of the Verkhovna Rada Secretariat, which considers that the draft law can be adopted as a basis after first reading if all the remarks are taken in consideration.
The Committee members recommended that the Verkhovna Rada of Ukraine adopt the draft law as a basis and in principle after its consideration in first reading.
