The draft law No.4365, which was considered by the Committee on April 14, proposes to suspend actions on the transfer of state property into municipal ownership prior to the adoption of draft laws of Ukraine "On Education" and "On Professional Education."
The draft law proposes to abolish Paragraph 4 of Article 27 of the Law of Ukraine "On the State Budget of Ukraine for 2016" (hereinafter - the Law), under which the Cabinet of Ministers of Ukraine is ordered to ensure the transfer from state ownership into municipal ownership of corresponding institutions, establishments and organizations / technical vocational schools and other educational institutions providing services of training of the labour /.
The provision of Paragraph 4 of Article 27 of the Law corresponds to Paragraph 1 of this article, according to which the Government is ordered to transfer by January 1, 2016 expenditures for training of the labour in technical vocational and other educational institutions to funding from local budgets.
The transfer of expenditures on training of the labour to funding from the budgets of towns of regional significance and regional budgets is regulated by the Budget Code of Ukraine in Item 1 of Article 89, Item 1 of Article 90 (corresponding amendments were made by the Law of Ukraine dated December 24, 2015 No.914-VIII “On Amendments to the Budget Code of Ukraine").
At the same time, by Paragraph 6 of Article 27 of the Law the Government is instructed to following the first quarter of 2016 carry out monitoring of funding of technical vocational schools in state ownership at the expense of regional and town budgets and, if necessary, make proposals regarding amendments to the budget law. However, as of today the Government has not provided information on the monitoring conducted over the said issue and therefore has not made the necessary legislative proposals.
Following the consideration, the Committee decided to recommend that the Verkhovna Rada adopt the draft law as a basis in the first reading and in principle / after the approval by the Verkhovna Rada of Ukraine of the decision touching the proposals of the President of Ukraine to reject the laws of Ukraine "On Amendments to the Budget Code of Ukraine concerning financing of technical vocational education" (Registration No.3831-2) and "On amendments to the Law of Ukraine "On the State Budget of Ukraine for 2016" concerning financing of technical vocational education" (Registration No. 3830-3).
