The legislative act presents article 961 of the Criminal Code of Ukraine in the following wording:

"Special confiscation is a compulsory uncompensated seizure by the court to the state ownership of money, valuables and other property in cases foreseen by this Code, in case of committing an intentional crime or a socially dangerous act that falls under the signs of the offense stipulated in the Special Part of this Code, which provides for major penalty in the form of imprisonment or a fine of over three thousand non-taxable minimum incomes, as well as under Section 1 of Article 150, Article 154, Sections 2 and 3 of Article 1591, Section 1 of Article 190, Article 192, Section 1 of Articles 204, 2091, 210, Sections 1 and 2 of Articles 212, 2121, Section 1 of Articles 222, 229, 2391, 2392, Section 2 of Article 244, Section 1 of Articles 248, 249, Sections 1 and 2 of Article 300, Section 1 of Articles 301, 302, 310, 311, 313, 318, 319, 362, Article 363, Section 1 of Articles 3631, 3641, 3652 of this Code."

According to the Law, "Special confiscation is applied on the basis of

1) a judgment of conviction;

2) a court ruling on exemption of a person from criminal responsibility;

3) a court ruling on the application of compulsory medical measures;

4) a court ruling on the application of compulsory educational measures.

In cases when the object of special confiscation has the property withdrawn from civil circulation, it can be applied on the basis of

1) a court ruling on termination of criminal proceedings on other grounds than the person's exemption from criminal responsibility;

2) a court ruling made in accordance with Section 9 of Article 100 of the Criminal Procedure Code of Ukraine, at a request of an investigator or a prosecutor if they close the criminal proceedings."

The Law was adopted as amended by the people’s deputies.

Respective draft law was registered under No. 4054.
