The Committee members considered the draft law No. 4020 submitted by the President of Ukraine. The draft law offers legislating equal opportunities to take decisions on the manning of the Armed Forces of Ukraine and other military units immediately in case of substantial changes in the military-political situation in the state.
During the discussion, the people's deputies drew attention to the fact that in compliance with the instructions of Section 6, Article 15 of the Law of Ukraine "On military duty and military service" the terms of a military draft (military drafts) for the following year are set with respective presidential decree posted by mass media not later than a month before the end of current year.
In such a way, the citizens of the draft age are safeguarded in their right to be preliminarily informed about the terms of the draft and the number of the following drafts for the next year. If a person does not agree with the decision of a draft committee, certain period of time is given to appeal against that decision at the draft committee of a higher level or at court under the order envisioned by the law (Section 5, article 16 of the Law).
The people's deputies consider that in conditions of the military aggression against Ukraine it is highly necessary to set special order of military draft, however, such order should be temporary (until the end of the special period) and be clearly determined in the Law of Ukraine "On military duty and military service."
