The draft law offers to envision opportunity to apply special confiscation in Article 961 of the Penal Code of Ukraine if committed are:
- intentional predicate offense or socially dangerous act that falls under the signs of the crime;
- crime, penalties for which directly imply such confiscation today.
The project also provides for amendments to the Criminal Procedure Code, which proposed to allow the seizure of property in criminal proceedings in cases of:
- the necessity to preserve evidence;
- application of special confiscation;
- confiscation as punishment (a measure of criminal law nature) to the individuals (legal entities);
- enforcement of a civil claim or recovery of improper advantage from a legal entity received.
Respective draft law was registered under No. 4054.
