The draft law No. 2871 offers to:
- introduce constitutional guarantees of independent trial into the procedure law;
- determine order and subjects of procedural actions in cases of judge disqualification within proceedings and respective court rulings;
- exclude provisions touching the opportunity to attract substitute judges to avoid certain conflict of laws; etc.
The draft law also offers to supplement the Criminal Procedure Code of Ukraine with new Article 20-1 "Independence of courts and their subordinance only to the law." Judges, members of the jury pass rulings in criminal proceedings on grounds of the law and in conditions that exclude any external influence.
The Committee members supported the draft law as its adoption will facilitate bringing the Criminal Procedure Code of Ukraine in line with the Constitution of Ukraine, raise disaffection and lawfulness during administration of justice.
