The draft law No. 2870 offers to amend the Criminal Procedure Code of Ukraine in order to: prevent from application of any other pre-trial restrictions but keeping in custody for persons involved in gravest crimes (amendments to Article 176 of the Criminal Procedure Code of Ukraine); introduce such a pre-trial restriction as recognizance not to leave, and an opportunity to apply it towards the persons suspected of minor crimes (new Article 180-1 of the Criminal Procedure Code of Ukraine in the wording of the draft law); etc.

The Committee explains the necessity for adoption of the draft law with the fact that the effective legislation not only endangers human rights and freedoms guaranteed by the Constitution of Ukraine, Universal Declaration of Human Rights, and Convention for the Protection of Human Rights and Fundamental Freedoms, but also entails violation of some provisions of the procedure law.

The Committee members supported the draft law concluding that its adoption will bring the criminal procedure law in line with the European standards of criminal justice to protect rights, freedoms and lawful interests of participants in criminal proceedings.
