In particular, the Law rules that the concentration can be provided only in case of preliminary permit of the Antimonopoly Committee or an administrative collegiate body of the Antimonopoly Committee in cases envisioned by Section 2 of Article 22 of this Law and other regulatory-legal acts, if:
the total cost of assets or total amount of sale of commodities of concentration participants (control relations inclusive) over the last fiscal year, inter alia abroad, exceeds the amount equivalent to EUR 30 million determined in compliance with respective official exchange rate set by the National Bank of Ukraine as at the last day of the fiscal year, at that the cost (total cost) of assets or the volume (total volume) of sale of commodities in Ukraine in fewer than two participants in the concentration (control relations inclusive) exceeds the amount equivalent to EUR 4 million determined in compliance with respective official exchange rate set by the National Bank of Ukraine as at the last day of the fiscal year in each; OR
the total cost of assets or the commodities volume sold in Ukraine by an economic entity, control over which is acquired, or an economic entity, whose assets, stakes (shares) are acquired in ownership or received in management and use over the last fiscal year exceeds the amount equivalent to EUR 8 million determined in compliance with respective official exchange rate set by the National Bank of Ukraine as at the last day of the fiscal year, and, at that, the volume of commodities sold by any other participant in the concentration over the last fiscal year, inter alia abroad, exceeds the amount equivalent to EUR 150 million determined in compliance with respective official exchange rate set by the National Bank of Ukraine as at the last day of the fiscal year."
