The draft law (No. 3023) proposes not to apply prohibitions envisaged in Sections 3 or 4 of Article 1 of the Law of Ukraine "On Government Cleansing," also to senior officers, who hold or held positions in the Ministry of Defense of Ukraine, the Armed Forces of Ukraine, the State Border Service of Ukraine, the National Guard of Ukraine and other established military formations in case it is predetermined by the need to ensure the defense capacity of the country and in case of satisfaction of the relevant application.
According to the Committee, the adoption of these amendments:
- Levels out the purpose and expected consequences of the adoption of the Law of Ukraine "On Government Cleansing," as to a greater extent it will expand the range of exceptions not covered by its force;
- Threatens the ability to effectively combat corruption and prevent from participation in public affairs management of persons who, through their action or inaction carried out activity aimed at usurpation of power, undermining of the foundations of the national security and defense of Ukraine, and unlawful violation of human rights and freedoms.
