The law clarifies the basic functions of the National Guard of Ukraine.
The National Guard is additionally entrusted with participation in stopping illegal actions of a group of detained/sentenced persons, and also eliminating such actions' consequences in pre-trial detention and penalty execution facilities.
The law envisages that the National Guard of Ukraine participates in performing tasks of territorial defense, rather than performs these tasks in full, as the current provision stipulates.
The law defines that the commander of the National Guard of Ukraine is appointed by the President of Ukraine.
Legislative act also clarifies a provision of the current Law on the strength of the National Guard of Ukraine. Thus, it sets the maximum number of all personnel, not only military, not exceeding 60,000 people. It also stipulates that during special period the number of the National Guard of Ukraine increases by a number of personnel called into military service in order to implement decrees of the President of Ukraine on mobilization, approved by the laws of Ukraine.
The Law regulates the question of authorities of the Ministry of Defence of Ukraine concerning the National Guard of Ukraine during martial law. This is due to the fact that the Ministry of Internal Affairs of Ukraine, the system of which includes the National Guard of Ukraine, is not the body of military administration and is only engaged in the implementation of measures of martial law.
The document also sets that the National Guard of Ukraine during martial law is transferred under the administration of the Ministry of Defense of Ukraine in order to perform the tasks of national defense.
Provisions of the current Law on the use by the National Guard Ukraine troops of special means, including firearms is coordinated with the Law of Ukraine "On the National Police of Ukraine."
The Law provides for a possibility of military service under contract in the National Guard of Ukraine of foreigners and stateless persons legally staying in the territory of Ukraine.
The Law also regulates the procedure of escorting sentenced persons.
The Law supplements Article 5 of the Law "On the National Guard of Ukraine" in the following wording:
"Creation, reorganization and liquidation of operational and territorial formations of the National Guard of Ukraine, their bodies of military command, military units, training units (centers), bases, health care institutions of the National Guard of Ukraine within the overall number and funds allocated from the state budget of Ukraine is carried out by the Minister of Internal Affairs of Ukraine in coordination with the President of Ukraine, and of higher military educational institutions of the National Guard of Ukraine - with the Cabinet of Ministers of Ukraine."
