The legislative act supplements Item 4 of Chapter XXI "Final and Transitional Provisions" of the Customs Code of Ukraine with provisions concerning temporary exemption from import duty of goods, which will be imported to Ukraine in the framework of the realization of the Bortnychi Sewage Treatment Plant modernization project.
At that, determined was that such exemption will be granted only on condition that the goods will be imported by Japanese business entity in charge of the project implementation, in line with the list and in volumes agreed by the Ukrainian business entity in charge of the project implementation with the Japan International Cooperation Agency. Also determined was that the incentives in payment of import duty will be granted on condition that the imported goods are not produced in Ukraine or produced in Ukraine, but do not meet the requirements of the Project.
The Law also supplements Item 4 of Chapter XXI "Final and Transitional Provisions" of the Customs Code of Ukraine with Item 42, according to which temporarily - for the period of the Project realization - may be placed under the customs regime of temporary importation with conditional full exemption of taxation with customs duties and without application of measures of non-tariff foreign trade regulation, goods, vehicles belonging on the ground of the ownership right or other property rights to a Japanese business entity implementing the Project and imported by such entity for the purposes of their use during the performance of works and / or provision of services in the framework of the Project implementation.
