The legislative act introduces amendments to the Criminal Code of Ukraine, the Criminal Executive Code of Ukraine, the Criminal Procedure Code of Ukraine, and Law "On administrative supervision over persons freed from detention facilities". The amendments foresee humanization of procedure of imposition and execution of punishment in the kind of life sentence.
The Law introduces imperative prohibition to impose punishment in kind of life sentence for offenses like preparing a crime and attempt to commit crime, and imposing this punishment against persons who perform as abettor and assistant during a crime.
The document allows applying release on parole for persons sentenced to life after no less than 20 years of service of the sentence and replacement of the life sentence by a sentence for certain period by an act of the President of Ukraine.
The Law envisages "pardon of a convict on the ground of an act of pardon in kind of complete or partial release from basic and additional punishments and replacement of life sentence by 25-year sentence.
In case of replacement of life sentence by 25-year sentence, the period of sentence includes all time of staying in detention and the period of practical stay in detention facilities.
Punishment in kind of 25-year sentence is not subject to further replacement by a softer punishment.
Motion on pardon can be submitted by convict, convict's lawyer, legal representative, close relatives, human rights organizations, including international human rights organizations pursuant to a procedure provided by the legislation."
The Law also envisages an option of replacement of the remaining part of punishment by softer punishments to persons serving life sentence (the softer punishment can be sentence for no less than 25 years), after the factual serving of at least ten years of sentence. The Law is adopted with corrections.
