Draft law No. 2538a defines measures consolidating social protection of orphaned children, children deprived of parental care, and persons with this status in the part concerning draft deferment during mobilization, education and health improvement.
During discussions the Committee members noted that Article 52 of the Constitution of Ukraine envisages that maintenance and education of orphaned children, children deprived of parental care is laid on the State. For this reason the state support of this category of children should be enhanced.
The Committee members said it is necessary to provide the right of orphaned children, children deprived of parental care to university education and the first job in order to create conditions for their further development. Unlike other children, orphaned children, children deprived of parental care, persons with this status cannot rely on support from parents and other relatives. For this reason orphaned children, children deprived of parental care, persons with this status should get certain benefits regarding university entrance and employment.
At the same time, the Committee members believe the draft law needs essential finalization during preparations for the second reading. It is necessary to make it clear how a benefit during university entrance will be applied. On the one hand orphaned children must be provided with opportunities to enter a university, on the other hand this should not narrow the rights of other children. It is also necessary to work further at a provision concerning draft deferment during mobilization to foresee that all students of vocational schools shall get draft deferment and not only orphaned children and children deprived of parental care.
