The draft law suggests updating Article 44 of the Customs Code with new Unit 121, which introduces a new notion "displacement of natural gas (backhaul)" and provides a definition for it.
The draft law introduces that " displacement of natural gas (backhaul) is an operation during which acceptance and transfer of natural gas is performed through paper formalization of opposite flows of natural gas:
which is in communicating gas transportation systems, by carriers-operators of the gas transportation system of Ukraine and a neighboring country separately on each point of acceptance and transfer of natural gas without its transportation by pipeline transport across the customs border of Ukraine;
which comes to the gas transportation system and/or is in gas storage facilities of Ukraine, including under customs control,- by carrier-operator of the gas transportation system of Ukraine and operator of gas storage facility without its physical pumping in the gas storage facility (pumping out from the gas storage facility)."
The draft law also defines features of the customs control and customs formalization of operations on displacement of natural gas (backhaul), namely a provision that during displacement of natural gas (backhaul) registration of natural gas crossing the customs border of Ukraine by pipeline transport is performed on the ground of documents signed by carriers.
