The aim of draft law No.2758 is introduction of "real guarantees" of the provision of the right to defense and participation in court proceedings for persons participating in the anti-terrorist operation and combat operations.
The draft law suggests lifting restrictions regarding suspension of case proceedings on the ground of a person's active military service and providing courts with a right to stop proceedings not only in cases when a person performs service at a legally registered place of residence, but also in cases when a person performs military service outside the place of permanent basing of a military unit (subunit).
In this connection Item 1, Section 1 of Article 202 of the Civil Procedure Code of Ukraine is suggested in a new wording.
Members of the Committee noted that the legislative initiative essentially widens the circle of persons entitled to apply to court with a motion to stop proceedings in a case because of military service.
They expressed an opinion that the amendments will facilitate defense in civil cases not only of persons performing active military service, but also of other participants in combat operations and the anti-terrorist operation.
