According to the Secretariat of the Committee, the draft law No. 2432a offers to:

— set single legislative terms to let water bodies, including water bodies used for aquaculture needs;

— ban the use of water bodies or coastal protection lines, including aquaculture ones, less lease agreements in compliance with the Law, while the violation of lease agreement requirements; and to rule that failure to pay (to untimely pay) rentals for the water body or land plot under that body would be a reason to terminate respective lease agreement;

— rule that letting of water bodies is regulated by the Water Code of Ukraine and the Land Code of Ukraine.

People's deputies took in account a conclusion of the Main Scientific-Expert Department under which the lease of water bodies had already been regulated by effective legislation. In compliance with Section 1 of Article 51 of the Water Code of Ukraine, water basins (except for water basins of multi-purpose), lakes, ponds and landlocked bodies of water can be let for the needs of fishery economy bodies. At the same time, according to Section 1 of Article 14 of the Law of Ukraine "On aquaculture," a fishery economy water body for the purposes of aquaculture is let to a legal entity or an individual in compliance with the Water Code of Ukraine.

Thus, according to the Committee members implementation of effective terms of the aforementioned legislative acts should be ensured through bringing a number of bylaws in line with, in particular, the Instruction on the order of artificial fish breeding, other live resources and their use in special commercial fisheries, etc.
