The draft law offers to supplement Article 4 with new Item 121. The Item introduces new notion of "backhaul" and determines its essence.
In compliance with the draft law, the backhaul is the transfer of natural gas via documental registration of counter-current flows of natural gas:
— which is kept in neighboring gas transport systems, - by carriers-operators of gas transport systems of Ukraine and a neighboring country on each reception station without its transmission by the pipeline transport through the customs border of Ukraine;
— which is delivered to the GTS and/or is kept in the underground gas storage facilities (USF) of Ukraine, including under the customs control - by a carrier-operator of the Ukrainian GTS and an operator of a USF without gas' physical pumping-in or -out of the USF.
The document also offers to supplement Section 3 of Article 341 as to determination of peculiarities of customs control and customs clearance of the backhaul operations, in particular, the provision envisaging that during a backhaul of natural gas, the accounting of the gas transited through the customs border of Ukraine by the pipeline transport is conducted on the basis of documents signed by the carriers.
According to the Secretariat of the Committee, the Committee members expressed certain remarks to the draft law and offered to take them in account during further adaptation of the document.
