As a result of the audit, the Counting Chamber of Ukraine found out the following:
— Law regulating issues of melioration and use of meliorated lands and melioration systems requires amendment and mutual coordination, in particular, in terms of determination of authorities of central and local executive bodies;
— peculiarities of operation of melioration systems in case of privatization of property of agricultural enterprises are still undetermined;
— issue of state control over the observance of rules on maintenance of melioration systems and use of meliorated lands is also unregulated;
— moral and physical aging of melioration funds, including melioration machinery and mechanisms;
— cases of embezzlement of elements of melioration systems, inter alia the state ones are increasingly often;
— registration of state rights to land plots and real estate facilities and their state registration is provided improperly.
At the end of the discussion, the Committee decided to recommend that the Cabinet of Ministers of Ukraine:
— speed up submission for the consideration of the Verkhovna Rada of the draft law on agreement of provisions of the Water Code of Ukraine and the Law of Ukraine “On melioration of lands” in a part of authorities of central executive bodies;
— ensure state control of observance of rules on maintenance of melioration systems and use of meliorated lands, and also determine legal, economic and organizational fundamentals of delivery of water to temporarily occupied territory of Ukraine (Crimea) from the North-Crimean Canal for the needs of water users of all categories.
At the same time, the Cabinet of Ministers suggested that water economy organizations and water-supply canal departments complete registration of rights of the state to land plots and real estate facilities, and also to their state registration.
