The Law rules that public information in the form of open data is public information in the format allowing its automatic processing by electronic means, ensuring free access, and also its further use.
Administrators of the information have to provide public information in the form of open data on request, publish and regularly renew such information on the single state web-portal of open data and on own websites.
Public information in the form of open data is allowed for its further free use and spreading.
Any person can freely copy, publish, spread, use, inter alia in commercial purposes, along with other information or via inclusion of such information into the list of own products, public information in the form of open data with mandatory reference to the source of such information.
Public information, containing personal data of individuals, is published and provided on request in the form of open data in case one of the following conditions is observed:
1) personal data does not name the person and is protected in compliance with the Law of Ukraine “On protection of personal data;”
2) individuals (data subjects), whose personal data is contained within information in the form of open data, agreed with the spread of such data in compliance with the Law of Ukraine “On protection of personal data;”
3) provision or publishing of such information is envisioned by the Law;
4) limitation of access to such information (its putting on the list of information with limited access) is prohibited by Law.
The list of sets of data subjected to publishing in the form of open data, requirements to the format and structure of such sets of data, periodicity of their renewal are determined by the Cabinet of Ministers of Ukraine. At that the Cabinet of Ministers of Ukraine is obliged to include the information, access to which is guaranteed with the Law, into the said list of sets.
Establishment and maintenance of the single state web-portal of open data is rendered by central executive bodies engaged in state policy in the field of electronic governing.
