The Verkhovna Rada of Ukraine adopted in the first reading two draft laws that were submitted by people's deputies of Ukraine, members of the TSC on Protection of IDPs' Rights.
Published on 17 July 2024, at 17:171) By 290 votes, the Verkhovna Rada of Ukraine adopted in the first reading draft law No. 11028 (link) on the priority right of certain categories of internally displaced persons to receive compensation for destroyed real estate objects.
The draft law provides that the priority right to compensation for destroyed real estate will be given to internally displaced persons who:
- have reached retirement age;
- have a dependent child under the age of 6;
- have two minor children to support;
- have a dependent child with a disability;
- raising a child under the age of 14 without one of the parents;
- are persons with disabilities of the III group.
2) By 280 votes, the Verkhovna Rada of Ukraine adopted in the first reading bill No. 11281 (link), which provides for the creation of an Information Database of real estate objects for the residence of IDPs, which will collect information about state, communal and, at the request of the owner, private objects property that is used or can be used for the residence of IDPs. All information will be publicly available in the form of an interactive map. As a result, IDPs will be able to apply for residence in selected facilities, and the state and international partners, humanitarian organizations will receive information about facilities in which funds can be invested for reconstruction, as well as how much money each facility needs.
In addition, the draft law proposes to provide that during martial law and for three years after its termination or cancellation, the property of educational institutions of various specializations and types (vocational, vocational-technical, preschool, higher education, etc.) that is not in use by appointment for 12 months in a row, is provided for rent for the residence of IDPs in accordance with the procedure established by the Cabinet of Ministers of Ukraine.
Also, the amendments to the Law of Ukraine "On Leasing of State and Communal Property" stipulate that state and communal enterprises, public and charitable organizations that provide housing for IDPs will have the right to lease state and communal property without holding an auction. The government is also instructed to establish preferential conditions for calculating rent for state and communal property for such tenants.
