The Verkhovna Rada of Ukraine adopted the Law “On ratification of Agreement between Ukraine and Malaysia on sending Malaysian personnel to Ukraine in connection with MH17 Malaysia Airlines plane crash”

Under the Agreement, Ukraine (the Receiving State) and Malaysia (the Sending State) (together – the Parties), taking into account United Nations Security Council Resolution 2166 of 21 July 2014, and the Agreement between the National Bureau of Air Accidents Investigation of Ukraine and the Dutch Security Council of the Kingdom of the Netherlands of 24 July, 2014; have agreed that the Sending State sends non-military personnel (Malaysian personnel) to the Receiving State in order to facilitate the recovery of remains and the conduct of the investigation called for in United Nations Security Council Resolution 2166 of 21 July 2014, and other activities as may be agreed between the Parties.        

Malaysian personnel include not more than 90 people of the Sending State.

Malaysian personnel have freedom of movement on the territory of the Receiving State in order to move to the areas connected with the investigation of the catastrophe. Malaysian personnel shall request permission of the Receiving State to move to any areas not connected with the investigation of the catastrophe.    

Malaysian personnel remain under Malaysian national command and coordinate its activity on the territory of Ukraine with the International mission to protect the investigation led by the Kingdom of the Netherlands.  

Malaysian personnel shall adhere to the legislation of the Receiving State and refrain from any actions incompatible with this Agreement, particularly, from any political activity in the Receiving State.    

Malaysian personnel are in contact with all the Parties, including the OSCE special monitoring mission to Ukraine.

Activity of the Malaysian personnel on the territory of the Receiving State terminates simultaneously with terminating the activity stipulated in clause 1.1. of this article, or by the agreement between the Parties.
